Pension Remedy Updates and Communication

Welcome to the Regional Pension Remedy Communication Portal which looks to provide serving and retired officers with relevant updates regarding the ongoing McCloud Remedy solution.

Latest Updates:

Following the passing of legislation, the ‘Pensions Remedy’ (arising from the McCloud judgment) has been progressed by Scheme managers in collaboration with pensions administrators nationally. To provide a central resource for ease of access to readily updated information, FAQs, Flyers and relevant forms where applicable, the NPCC (National Police Chiefs Council) have launched a dedicated web site:

www.policepensioninfo.co.uk

All members are advised accordingly as this site is seen as a key facility for easily accessible information. The local Scheme Manager would ultimately be responsible for Police Pension matters but this is seen as a helpful resource.

McCloud Police Officer Pension Remedy- Calculator

You will be aware that the transitional arrangements for transfer from the 1987 legacy police pension scheme to the 2015 CARE police pension scheme were found to be discriminatory. Assuming the Public Services Pensions and Judicial Offices Bill is passed through parliament to remedy that position, Officers previously fully protected in the legacy scheme will transfer to the 2015 scheme on the 1 April 2022.

An online calculator and modeller has been developed by Government Actuary Department on behalf of the NPCC to provide projected benefits under McCloud Remedy. At present, the calculator only offers projections for 1987 legacy scheme and 2015 scheme membership.

XPS, the Police Pension Administrators, have agreed to host the calculator but they are NOT responsible for the financial projections that are provided and are unable to assist with any queries related to using the calculator or the calculations produced. Calculations are for guidance purposes and provide estimates only. Please ensure that you read the Home screen and T&C’s which have full details on what the calculator provides and how to use it.

The calculator can be accessed by clicking on this link where you will find a section called ‘Access to Calculator’ at the end of the page.

McCloud Police Officer Pension Remedy – Lifetime Allowance (LTA)

You will be aware that the transitional arrangements for transfer from the 1987 legacy police pension scheme to the 2015 CARE police pension scheme were found to be discriminatory. Assuming the Public Services Pensions and Judicial Offices Bill is passed through parliament to remedy that position, Officers previously fully protected in the legacy scheme will transfer to the 2015 scheme on the 1 April 2022.

It has come to our attention that if you are a member of the Police Pension Scheme 1987 and have “fixed or enhanced protection” for your pension Lifetime Allowance (LTA), then you have a decision to make. You will know if you have fixed or enhanced LTA protection because you will have applied for it and have a certificate from HMRC.

XPS, the pension administrators, do not believe that there are any active Officers in Force that are affected but as this is a personal tax matter it is your responsibility to check if you are.

If you are a member who has fixed or enhanced protection with regards to your pension Lifetime Allowance (LTA), please ensure you read document 19 Feb 2022 HMRC guidance below and take the necessary action to ensure that the pension changes the Government are introducing on the 1 April 2022 do not cancel your protection. Please speak with an Independent Financial Advisor for any further advice.

  1. Section 11 on contributions adjustments amended the contributions payable to the PPS 06 and PPS 87 Schemes
  2. Added a section at 13 on retirement before October 2023
  3. Added a section at 14 on Immediate Detriment
  4. Changed the section on Opting out (18 in new version 16 in old). Understanding of Deferred Pensions. This reflects that someone under 50 with at least 25 years service would not have their pension deferred until age 60. It is however important that those considering opting out understand that the individual will lose the benefit of weighted accrual and final salary link and will have their lump sum restricted to 2.25x their pension.
